Cyber Insurance and the Internet of Things

The risks of cyber-attacks have caught the attention of insurance carriers with A.M Best reporting “Cyber Risk” as the most used phrase in the insurance industry in 2015. To determine the best coverage and carrier for your organization, the ABA recently published the book, Protecting Against Cyber Threats: A Lawyer’s Guide to Choosing a Cyber-Liability Insurance Policy. For some background on this newer form of insurance review “Cyber Insurance Can Be Your Worst Nightmare or Best Friend” from Network World. Perhaps fear of the internet of things swayed you to obtain cyber insurance. ILTA member, Nicole Schnarre, recently shared an internet of things article “Introducing the Right to Eavesdrop on Your Things.” With more wearables at various price points on the market beyond the Apple watch, organizations must consider the “Management and Security Implications of the Smartwatch at Work.”

LegalSEC Summit – a Talk with David Michel

David Michel, Director of Technology at Broad and Cassel, developed three sessions for the LegalSEC Summit. He told me about some highlights and takeaways.

  1. “The Internet of Things Are Lurking,” session will break away from the traditional cyber security focus of the Summit. This session will address concerns in legal about the internet of things in offices and conference rooms. With the speakers Jeff Brandt of PinHawk and Jackson Kelly and Steve Boyce from Microsoft, attendees will understand internet of things capabilities and how to respond to threats.
  2. In developing “Getting and Staying Secure Without a Security Expert on Staff,” David hoped to help his peers in small to mid-sized firms. “I know these firms don’t always have the budget for a full-time security staff member but you need to be secure, so what do you do?” This session, presented by David Forrestall, a security consultant at Securit360, Kenneth Levonaitis, a CIO at McCarter & English LLP, and Keith Franco a Security Manger also of McCarter & English will tell the story of firms that started with an outside consultant and eventually hired a security professional full time. The presenters will identify key indicators for maintaining a consultant or for bringing the work in-house.
  3. With “Security Tools for your Non-Geeky IT Staff,” David recognized the market has great and sometimes cheap tools, “but let’s be honest. You have to be kind of geeky to get some of those to work.” David explained that many firms have great administrators who can run the systems but have trouble and too little time for tools like Splunk and Wireshark . This session, presented by Douglas Brush, a security consultant at Kraft & Kennedy, and Tashfin Wahid of Fried Frank Harris Shriver & Jacobson LLP, provides the audience with tips and tricks to apply right away at their firms using free or low-cost easy to manage tools. No scripting required!

Just as I asked Richard Martinez and Scott Rolf, I also asked David Michel what tools, policies or processes help him sleep better. David’s firm recently migrated to Office 365 for email, he plans to move to a hosted SharePoint intranet and his firm already uses NetDocuments. As an admitted proponent of the cloud, he feels secure because he has layered security and has partnered with respected cloud companies with legal expertise. He said, “As long as you dot your i’s and cross your t’s on contracts and you know and trust your vendors, you can be more secure in the cloud than on premise.” While attending the LegalSEC Summit, David looks forward to learning about the latest issues and solutions regarding security audits and what’s next that he needs to know.

 

SharePoint || Office 365 Symposium – a Talk with Jen Raatz on a Creative Business Solution

Jen Raatz, Practice & Client Solutions Consultant for Foley & Lardner LLP, will return to the SharePoint ||Office 365 Symposium for a third year. As a first-time speaker at the Symposium, she will wow attendees with her innovative SharePoint 2013 solution, FOLEY Global Risk Solution (GRS). This business solution began with two Foley Government Enforcement, Compliance & White Collar Defense attorneys identifying a need for a Foreign Corrupt Practices Act (FCPA) and anti-bribery compliance solution for middle market companies. In recent years the Department of Justice and the Securities Exchange Commission increased scrutiny on middle market companies for violations of the FCPA. The attorneys recognized middle market companies often do not have sufficient in-house counsel to handle the risk assessment and ongoing compliance, nor can they afford the hourly rates of an AmLaw 100 firm. The Practice & Client Solutions team took on the project using SharePoint 2013 with Jen liaising with the attorneys. She said, “You can do anything with SharePoint, but it takes a team and we have a great team of developers at Foley.” The GRS team created a fixed-fee solution on a portal with several innovative components. Some FOLEY GRS highlights include a risk assessment tool using Neota Logic that generates an automated planning report, multiple training modules using Click4Compliance for global sales teams and for executives, a wizard tool to find quick answers to FCPA and anti-bribery compliance issues, a resource page with forms, sample documents, third-party contract language, and much more.

You will want to attend Jen’s session, “Innovate Your SharePoint,” to learn more about this tool and what’s next for Foley. I asked Jen about the success of FOLEY GRS. She said, “We launched on Feb 1, 2015. Within seven months we achieved ROI and that included significant internal development costs…  By end of year one, we had a 30.3 percent ROI.” To learn more about this successful and innovative business solution see the Foley videos and background information.
